Finland’s Supreme Court has rejected an appeal by prosecutors to convict a 23-year-old asylum seeker who had sex with a 10-year-old of aggravated rape, ruling she was not forced.
The unnamed migrant, who was 20-year-old at the time of the attacks, was convicted of aggravated sexual abuse of a minor and handed a light three-year sentence by a district court, with an additional charge of aggravated rape being thrown out, reports Yleisradio Oy (Yle), Finland’s public broadcaster.
The decision baffled prosecutors and caused outrage among members of the public, but was upheld by an appeal court, which agreed there was “no evidence to indicate that the sexual encounter involved violence or that the child was overcome by fear or incapacitated in any other way”, according to Yle.
The ruling resulted in what Yle describes as a “spirited public debate”, with Turku University’s Jussi Tapani and Matti Tolvanen of the University of Eastern Finland, both professors of criminal law, taking the judiciary to task in the national press.
Tuula Tamminen, Professor of Child Psychiatry at the University of Tampere, told the press there was no way the 10-year-old victim could have really understood what was happening to them.
Nevertheless, the Supreme Court has upheld the decision of the district court and the appeal court, and the migrant’s short sentence will not be increased.
Kari Tolvanen MP, who chairs the Law Committee in the Finnish parliament, has said the case shows the criminal law dealing with aggravated sexual abuse of a child needs to be amended, and claimed he supports longer sentences for such offences.
“The amendment would introduce harsher sentences for serious sexual offences against children overall. In my view that is fully justified, for example in light of a child’s vulnerability, even if the act does not meet the threshold for rape,” Tolvanen added.
Update, 7:15 PM Eastern: CBC News posted video of the police confrontation with the suspect, who can be heard yelling “Kill me, I have a gun in my pocket, shoot me in the head!” and brandishing an object at the officers.

Sunnybrook Hospital reports that ten victims were brought to its trauma center. Two of them died, five are in critical condition, two are in serious condition, and one is in fair condition.
Public Safety Minister Ralph Goodale described the incident as an “attack,” but would not confirm whether it has been classified as a terrorist attack. As a precaution, security has reportedly been increased at the Air Canada Center in downtown Toronto for the Stanley Cup playoff game tonight.

Mental illness, a keen interest in Nazi Germany, and rage at women because he couldn’t get a girlfriend were all cited as motivating factors for Rodger.
Update, 6:45 PM Eastern: CBS news has claimed to have identified the driver of the van as 25-year-old Alek Minassian while U.S. sources have told Reuters that terrorism is the leading theory for the motivation for the attack. Toronto police have not confirmed the identity of the suspect in the attack and a press conference is scheduled for later this evening.
Canadian broadcaster CTV has confirmed that Minassian is the suspect in police custody, though Toronto police claim that he was not previously on their radar.

#BREAKING: CTV News has confirmed the driver of the van allegedly involved in this afternoon’s deadly incident is named Alek Minassian. Sources say he is not known to police and motive for the incident is not yet known.
Police in Toronto reported multiple injuries and fatalities after a white van struck pedestrians at the busy intersection of Yonge Street and Finch.
The incident occurred in the early afternoon at the intersection which lies close to the Finch subway and bus station, one of the busiest transport hubs in the city of Toronto. One suspect appears to have been arrested.
Newstalk 1010 reports that up to 9 people are dead following the attack.
Witnesses told local TV crews that the driver was traveling at around 45 miles per hour, “crumbling up people” and taking the action “intentionally”.

Photos, which has been posted online show multiple people on the ground as a result of the incident. The Toronto subway system, known as the TTC, has shut down service to Finch station in response.
Toronto police are now reporting multiple fatalities following the incident which has seen a man, described as being “Middle-Eastern” in appearance, arrested a short distance away.

Alex Shaker, who was driving at the time of the incident and witnessed the van hit multiple people, told CTV News: “He started going down on the sidewalk and crumbling down people one by one. A FAMILY allegedly let off their daughter’s rapist after a sick trade let the victim’s brother do the same to her attacker’s sister.
The twisted case of “revenge rape” involving two families has been uncovered by cops in Pakistan.
One man had been accused of raping a woman in Pir Mahal in the Toba Tek Singh district of Punjab province, on March 20.
The suspect’s family had approached the victim’s family for “pardon and reconciliation”, according to local news reports.
Staggeringly the victim’s family agreed to pardon the rapist, on the appalling condition that “her brother would commit the same act with the suspect’s sister”, dawn.com reports.
A meeting between the two families agreed to the terms, and the brother then allegedly had sex with the suspected rapist’s sister on March 21.
Cops found out about the case when the two families prepared legal documents agreeing not to press charges against each other.
Pir Mahal Police Sub-Inspector Shaukat Ali Javed saw the papers and reported the families to his superiors.
All 12 people at the meeting, including four women, one of which was the victim of the second rape, were arrested on Saturday.
The case has chilling similarities another incident in the southern city of Multan last July, where a village council ordered the “revenge rape” of a 16-year-old girl.
The girl’s brother had sexually assaulted a 12-year-old, and the attack was reportedly carried out in front of her parents and 40 members of the village council.

Murder of elderly woman in Paris probed as anti-Semitic
French authorities say the killing of an elderly Jewish woman in Paris is being investigated as an anti-Semitic murder. The woman, identified in French media as Mireille Knoll, was stabbed at least 11 times and her body was set on fire.
The Paris prosecutor’s office said Monday two suspects have been put in custody. It said it is asking investigating judges to charge the pair with premeditated murder of a vulnerable person for anti-Semitic motives.
The office also asked for the suspects to be jailed pending trial.
Leading Jewish group CRIF said the 85-year-old woman was slain last week in Paris’ eastern 11th district. The victim had reportedly escaped a round-up of Jews in Paris during World War II. The group says a neighbor who had previously made anti-Semitic statements was one of the people under arrest. They didn’t confirm reports that the man was Muslim.
CRIF asked for “utmost transparency in the ongoing investigation so that the reasons for this barbaric crime are known to everyone as soon as possible.”
The group plans a rally in her memory and support of her family on Wednesday.
The body was found the same day a gunmen killed several people in an attack on a supermarket in southern France.

21-year-old Mohammed Abdul, of McMillan Street, London, has appeared in court on charges of attempted murder after a car was driven into a crowd outside a nightclub in Gravesend, Kent.
Abdul is thought to have smashed into revellers in a Suzuki Vitara at Blake’s, Queen Street, injuring 13 people, KentOnline reports.
18-year-old Gravesend resident Elena Napoliello described how she and a friend were “standing in front of the bar in the marquee, waiting for our coats to be taken to the cloakroom [when] all of a sudden, I saw multiple people falling backwards onto us, and so I was confused as to what was happening.
“Then, I saw the headlights of the car coming towards me and my friend and we got pushed backwards by one of our friends to get us into safety.
“I could see everyone surrounding this 4×4, but there was nowhere for us to go, so we had to hide in the back of the marquee. Everyone was shouting to ‘get down and hide’, which is what we were doing.
“When I could see the car coming towards me, I could see everyone kicking and punching the car trying to stop it and then the next minute I could see the guy on the floor. I didn’t see him very clearly because everyone was surrounding him.”
Detective Chief Inspector David Chewter thanked “the security staff at the nightclub as well as those members of the public who helped” after what he described as “the collision”, and noted that “many people” were injured in “the incident”.
Injuries reported include a dislocated knee, a broken shin bone, and one woman whose pelvis was either shattered or dislocated, according to conflicting reports. Fortunately, none of the injured are thought to be in danger of death.
The attack is not being treated as terror-related.
A British sniper has killed a senior ISIS fighter with a ‘one in a million’ night-time shot from nearly a mile away, it has been claimed.
The unnamed SAS marksman is said to have killed the terrorist with a ‘head shot’ close to the Syrian border having been given a window of just 15 seconds.
He is understood to be a sergeant with the SAS G-Squadron and a veteran of operations in both Iraq and Afghanistan, where he is said to have recorded as many as 100 kills.
According to the Daily Star Sunday, he is believed to have used a US-made McMillan TAC-50 sniper rifle as he targeted the fanatic from more than 1,500m away as he arrived at a safe house in a village.
The trooper is reportedly part of a counterterrorism drive in Iraq and Syria, which has been operating since the beginning of the year.
A source told the newspaper that the village in question was under ISIS control making a more preferable ‘capture mission’ impossible. The exact location has not been revealed.
‘The SAS team had hoped that the ISIS commander would arrive during the day because a night shot was regarded as too dangerous,’ the source said.
‘But as evening approached the team realised that they were going to have to either abort or go for a night shot. The sniper said he wanted to take the shot and was given a “go order”.’
The sniper had 15 seconds to take his shot as the extremist pulled up in a car. The source said the extremist was killed instantly after being shot in the back of the head.
The Ministry of Defence declined to comment when contacted by MailOnline this morning.
