The GOP’s business-first leadership has expanded the H-2B visa-worker program, so reducing marketplace pressure on companies to offer higher wages to Americans just months before the November election.
The pre-election giveaway is buried on page 1760 of the 2232-page 2018 omnibus bill, where language allows the Department of Homeland Security to greatly expand the size of the H-2B visa-worker program up to roughly 100,000 imported workers:
SEC. 205. Notwithstanding the [66,000] numerical limitation set forth in section 214(g)(1)(B) of the Immigration and Nationality Act (8 U.S.C. 1184(g)(1)(B)), the Secretary of Homeland Security, after consultation with the Secretary of Labor, and upon the determination that the needs of American businesses cannot be satisfied in fiscal year 2018 with United States workers who are willing, qualified, and able to perform temporary nonagricultural labor, may increase the total number of aliens who may receive a visa under section 101(a)(15)(H)(ii)(b) of such Act (8 U.S.C. 1101(a)(15)(H)(ii)(b)) in such fiscal year above such limitation by not more than the highest number of H–2B nonimmigrants who participated in the H–2B returning worker program in any fiscal year in which returning workers were exempt from such numerical limitation.
The jargon gives the green light to Senators and Representatives to pressure DHS leaders until unless they agree to hand out more H-2B visas to the politicians’ local employers.

“This shows that Congress uses the budget process to grant special access to insider lobbyists,” said lawyer John Miano, who opposes visa-worker programs. “By granting the ability to slip special interest provisions into a bill that must pass Congress, it rewards those who supply donations,” he added.

The H-2B visa-workers are imported by landscapers, forestry companies, seafood processors, construction firms, resorts, hotels and restaurants to import foreign workers for seasonal work. The imported workers are not cheap — see the data here — but their arrival means that employers do not have to raise their wages to persuade Americans to take seasonal jobs.
Moreover, if they raised their wages high enough to attract Americans to the seasonal jobs, then the companies would also have to raise wages for their year-round and supervisory workers.
Those extra wages would reduce company profits, raise costs and reduce the number of customers, and shrink the number of companies. But the extra wages would also leave hundreds of thousands of American voters working in higher-wage jobs, and would also nudge many additional employers to raise wages.
That free-market outcome is anathema to many GOP leaders, including House Majority Leader Paul Ryan. He has repeatedly said that immigration rules should be tuned to help employers — not employees — and that CEOs should be allowed to hire “any willing worker,” even if those workers live far outside the United States.
In 2015, Ryan sharply increased the size of the H-2B program, but after Donald Trump’s shocking victory in 2016, he let the program return to the 66,000 level.
In 2017, Ryan against pushed to expand the program with a 2018-style rule that encouraged legislators to pressure DHS officials for additional visas. Under then-DHS chief John Kelly, the agency reluctantly granted some additional visas, but far fewer than sought by business groups.
In 2018, the Department of Homeland Security has started distributing the 66,000 regular H-2B visas via a lottery because so many companies asked for a share of the H-2B visas.
The H-2B program is dwarfed by the size of the white-collar guest worker programs, via the H-1B, L-1, J-1, H-4, TN, and OPT programs. Collectively, these white-collar outsourcing visas keep more than 1 million foreign university graduates in healthcare, computer, business, and design jobs sought by American graduates.
The existence of the H-2B visa program creates a “crony-capitalist” economy. Companies which win the government-provided workers get to reduce their payroll costs, win more customers and generate more profits. Companies which do not get H-2B workers shrink and lose business. This dynamic forces many companies and labor-brokers to compete for the H-2Bs and to lobby for even more H-2Bs, so generating business donations and endorsements for politicians — at the cost of cutting wages for many Americans.
The program also distorts local economies. For example, in forest towns, the program allows out-of-state forestry contractors to ignore local job-applicants in favor of foreign H-2B workers.

Peter Schweizer, president of the Government Accountability Institute, highlighted Senate Majority Leader Mitch McConnell’s (R-KY) financial ties to the Chinese government as an example of how politicians monetize political influence while evading financial disclosure regulations.
Schweizer joined Monday’s edition of SiriusXM’s Breitbart News Tonight for an interview with co-hosts Rebecca Mansour and Joel Pollak to discuss McConnell’s linkages to China, as detailed in his latest book, Secret Empires: How the American Political Class Hides Corruption and Enriches Family and Friends.
Senate Majority Leader Mitch McConnell’s (R-KY) familial ties to the Chinese state via his father- and sisters-in-law are causes for concern, deduced Schweizer. James Chao, McConnell’s father-in-law, founded Foremost Group, a shipping company that has done “large volumes of business” with Chinese state-owned companies. McConnell’s wife, Elaine Chao, is the current secretary of transportation.
“So Mitch McConnell, the Senate majority leader, his wife Elaine Chao, who’s the transportation secretary in the Trump administration, her family has deep economic and financial ties to the Chinese government itself,” said Schweizer. “They are in the shipping business, and they own something called the Foremost Group, and really, in 1993, Mitch McConnell, as a senator, travels to China with his father-in-law, James Chao, as guests of the China State Shipbuilding Corporation.”
He continued, “The China State Shipbuilding Corporation is the largest defense contractor in China, and the projections are that by 2030, if current trends continue, they are going to surpass the U.S. Navy as far as naval capability. Basically, what happens is, the China State Shipbuilding Corporation says to the Chao family, ‘Look, we will build your ships. We will finance the purchase of some of your ships. We will provide crews for your ships. We will provide contracts for you to ship state-owned goods from state-owned companies around the Pacific. In other words, we are going to set you up in the shipping business,’ which is exactly what they do, and, in fact, James Chao — this would be Elaine Chao’s father, Mitch McConnell’s father-in-law — and Elaine’s sister, Angela Chao, actually joined the board, in 2007 and 2008, of something called China State Shipbuilding Corporation, CSSC Holdings, which is a subsidiary of the largest defense contractor in China. So you have this powerful American political family that is making U.S. policy related to China, related to trade, and other critical issues that is highly dependent upon the good graces of the Chinese government.”
Schweizer framed McConnell’s “increasingly soft” political positioning towards China as a function of his familial and financial ties to the Chinese state.
“McConnell himself has benefited because a few years ago, James Chao gave Mitch McConnell a gift between five and twenty-five million dollars that more than quadrupled his net worth overnight,” noted Schweizer. “So this is not just about Elaine Chao’s family getting wealthy. That wealth has now trickled into Mitch McConnell’s pocket, as well, and it’s a huge problem because if you chart the positions that Sen. McConnell has taken on China over the last twenty years, guess what? Shock of all shocks, he has become increasingly soft as it relates to China, and I think it is directly related to the fact that he knows his family’s financial future is tied to the good graces and good faith of the Chinese communist government.”
Schweizer described the Chinese government as “freaked out” over the election of Donald Trump to the presidency, owing to the 45th president’s decades-long view of the “rising threat of China.”
“So the election of Donald Trump, there’s no other way to say it, it completely freaked out the Chinese government because Trump has really been focused — whether one agrees with him on trade policy or not — he has focused since the 1980s on what he regards as a rising threat of China; whether it relates to trade, economics, or military power,” surmised Schweizer.
According to Schweizer, China’s decision to appoint McConnell’s sister-in-law, Angela Chao, to the Bank of China’s board of directors — ten days after 2016’s presidential election — was a response to the election of Trump to the White House.
“So when [Donald Trump] gets elected in 2016, China is in a panic. So one of the things that happens is, they appoint, really, the first American, or only the second foreigner to the Bank of China,” Schweizer said. “Now, the Bank of China is government-run, government-controlled, is sort of the backbone of the Chinese government’s economic diplomacy around the world. Ten days after Donald Trump is elected, they put Elaine Chao’s sister — Mitch McConnell’s sister-in-law — on the board of directors of the fourth largest bank in the world, which is run by the Chinese communist government. It’s a shocking development, and, again, unprecedented in American history that you would have senior political leaders have immediate family members that are sitting on the board of foreign government-owned businesses.”
An associate of Arizona Sen. John McCain is invoking his Fifth Amendment rights in order to avoid revealing information to Congress about the Steele dossier.
David J. Kramer, a former State Department official, pleaded the fifth in response to a subpoena issued in December by the House Permanent Select Committee on Intelligence, Fox News reported.
In a Dec. 19 interview with the committee, Kramer said that he had information about some of the sources of information in the dossier, which was written by former British spy Christopher Steele and financed by former Secretary of State Hillary Clinton’s campaign and the Democratic National Committee.
Kramer learned the information in Nov. 2016, after traveling to London to meet with Steele. Kramer and McCain, a Republican, first learned of the dossier earlier that month after meeting with an associate of Steele’s.
After the London meeting, Steele provided a copy of the dossier to Kramer with instructions to share it with McCain. The senator then provided a copy of the document to then-FBI Director James Comey during a Dec. 9, 2016, meeting.
The House Intelligence Committee issued a subpoena on Dec. 27 to compel Kramer to discuss the dossier’s sources.
Kramer, who was a director at the McCain Institute and now works for Florida International University, has avoided speaking publicly about his handling of the dossier. There has also been widespread speculation that he is BuzzFeed’s source for the document. The website published the dossier on Jan. 10, 2017.
In addition to his interview with the Intelligence Committee, Kramer was deposed in December as part of a lawsuit filed against BuzzFeed for publishing the dossier. Kramer’s lawyers have requested that his deposition in that case be sealed.
Steele, McCain and Fusion GPS, the firm that hired Steele to write the dossier, have all denied being BuzzFeed’s source. Kramer is the only person known to have handled the completed dossier who has not denied providing it to BuzzFeed.
Kramer and his attorney have not responded to numerous requests for comment.
McCain Associate Who Handled Dossier Asks Judge To Seal Deposition
An associate of Arizona Sen. John McCain’s who handled the dossier is asking a federal judge to block the release of a videotape and transcript of a deposition he recently gave in a lawsuit related to the salacious document.
David Kramer, a former State Department official and former director at the McCain Institute for International Leadership, filed a motion in federal court in Florida asking a judge for a protective order to block the public release of his deposition.
Kramer was deposed last month by lawyers for a Russian businessman suing BuzzFeed News for publishing the dossier. The lawyers for the businessman, Aleksej Gubarev, are interested in Kramer because he is one of just a few people known to have handled the dossier after it was completed by former British spy Christopher Steele and before its Jan. 10, 2017 publication.
Gubarev’s attorneys want to find out whether BuzzFeed’s source gave any warnings about the veracity of the dossier and whether it was verified or unverified.
Steele, McCain and Fusion GPS, the opposition research firm that commissioned the dossier on behalf of Democrats, have all denied being BuzzFeed’s source.
Kramer has not commented publicly on the issue.
Kramer’s lawyer, Marcos Jiminez, argued in a motion to seal that the release of the deposition would jeopardize his personal safety, make him subject to hounding from the press, and conflict with congressional investigations looking into the dossier.
Kramer was interviewed by the House Intelligence Committee last month and has also met with the Senate Intelligence Committee.
“Mr. Kramer seeks to prevent the Plaintiffs from sharing his videotaped deposition and accompanying transcript beyond the instant litigation,” wrote Jiminez.
He asserted that Kramer’s deposition in the BuzzFeed lawsuit “would reveal the extent of the Congressional Committees’ knowledge regarding the information provided by Mr. Kramer in closed-door sessions.”
Jimenez also argues that should Kramer’s deposition be released to the public, he “will be hounded by the press.”
Kramer and McCain first learned of the dossier shortly after the 2016 election while attending the Halifax International Security Forum. On the sidelines of that event, Kramer and McCain had a conversation with Sir Andrew Wood, a former British ambassador to Russia and associate of Steele’s.
Kramer then traveled to London to meet with Steele. While there, the pair made arrangements for Kramer to obtain the dossier back in the U.S. and to provide a copy to McCain.
McCain shared an incomplete version of the dossier with then-FBI Director James Comey on Dec. 9, 2016. The Republican was unaware at the time that Comey and the FBI were already aware of Steele’s report. FBI agents met with the ex-spy multiple times prior to the election.
Steele published his final dossier memo on Dec. 13, 2016. It is that document which alleges that Gubarev used two of his web-hosting companies to hack into the Democratic National Committee’s computer systems prior to the election. The dossier also alleges that Gubarev was recruited under duress by Russia’s spy services. He denies all of the allegations. In addition to suing BuzzFeed, he is suing Steele in London, where the former spy is based.
In court filings there, Steele has acknowledged that the Dec. 13 memo contained unverified information.
As of the beginning of this month, Steele and Fusion GPS have dodged requests for depositions from Gubarev’s lawyers.

Today Fox News reported President Obama asked the FBI for updates on the Hillary Clinton email investigation.
“[Lisa] Page wrote to Strzok on Sept. 2, 2016, about prepping Comey because ‘potus wants to know everything we’re doing,'” Fox News reports. “According to a newly released Senate report, this text raises questions about Obama’s personal involvement in the Clinton email investigation.”
But in an April 2016 interview on Fox News Sunday, then-President Obama said he “guaranteed” he was staying out of the FBI probe.
“I do not talk to the Attorney General about pending investigations,” Obama told Chris Wallace. “I do not talk to FBI directors about pending investigations. We have a strict line and always have maintained it –”
Asked to assure the American people the FBI probe into Hillary Clinton would be treated no differently than anyone else, Obama was emphatic: “I guarantee it. I guarantee that there is no political influence in any investigation conducted by the Justice Department or the FBI, not just in this case but in any case. Full stop. Period.”

WALLACE: “Mr. President, when you say what you just said — what Josh Earnest said as he did, your spokesman, in January — ‘the information from the Justice Department is that she’s not a target,’ some people, I think, are worried whether or not the decision, whether or not how to handle the case, will be decided on political grounds, not legal grounds. Can you guarantee to the American people, can you direct the Justice Department to say, ‘Hillary Clinton will be treated as the evidence goes, she will not in any way be protected.'”
OBAMA: “I can guarantee that. I can guarantee that not because I give Attorney General Lynch a directive, that is institutionally how we have always operated. TEL AVIV — Last week’s release of a four-page House Intelligence Committee memo alleging abuse of surveillance authority provides details that raise new questions about Sen. John McCain’s role in delivering the infamous, largely discredited 35-page dossier on President Donald Trump and Russia to the U.S. intelligence community under Barack Obama’s administration.
The memo, crafted by House Republicans, reveals, among other things, that former FBI Director James Comey personally signed FISA court applications utilizing the dossier to obtain FISA court warrants to conduct surveillance on Carter Page, who briefly served as a volunteer foreign policy adviser to Trump’s 2016 presidential campaign.
Comey allegedly utilized the dossier, produced by the controversial Fusion GPS opposition research firm, to seek and receive the first warrant against Page on October 21, 2016. Federal agencies sought the renewal of the order every 90 days in accordance with court requirements. According to the memo, Comey “signed three FISA applications in question on behalf of the FBI, and Deputy Director Andrew McCabe signed one.”
Comey allegedly utilized the dossier to seek the initial warrant even though he would label the same dossier “salacious and unverified” eight months later during sworn testimony.
Comey also utilized the dossier, according to the memo, even though senior FBI officials were aware at the time that the document, authored by ex-British spy Christopher Steele, was produced by the controversial Fusion GPS firm and was funded by Hillary Clinton’s 2016 presidential campaign and the Democratic National Committee (DNC) via the Perkins Coie law firm.
The questions about McCain’s involvement follow an admission last month by the founders of Fusion GPS that they helped Steele share the document with the Arizona senator utilizing a surrogate after the November 2016 presidential election. McCain in turn reportedly provided the dossier to the FBI in December 2016.
The timeline revealed in the memo shows that by the time McCain delivered the dossier to the FBI leadership in December 2016, the agency had not only already launched an investigation into Trump’s campaign partially utilizing the dossier but Comey himself had two months earlier signed an application using the dossier to obtain a FISA warrant on Page.
It is therefore not clear why Fusion GPS would seek out McCain to deliver to the FBI a document already being utilized by the agency to launch a probe into Trump’s campaign and obtain a FISA warrant after Steele himself provided the dossier to the FBI in July 2016.
It is also not clear whether, at the time he delivered the dossier to the FBI, McCain was aware of the origins of the information, primarily that Fusion GPS compiled the charges and that they were paid to do so by Clinton’s campaign and the DNC.
McCain has not responded to multiple Breitbart News requests for comment.
Necessity of McCain delivering dossier
In August 22 testimony released last month, Fusion GPS Co-Founder Glenn R. Simpson stated that Steele’s outreach to the FBI was “something that Chris took on on his own.” Simpson stated that as far as he knew Fusion GPS did not fund Steele’s July 2016 trip to Rome to meet with the FBI. He said he believes that the trip expenses may have been reimbursed by the FBI.
In a New York Times oped last month, Simpson and fellow GPS Co-Founder Peter Fritch relate that they helped McCain share their anti-Trump dossier with the Obama-era intelligence community via an “emissary.”
“After the election, Mr. Steele decided to share his intelligence with Senator John McCain via an emissary,” the Fusion GPS founders related. “We helped him do that. The goal was to alert the United States national security community to an attack on our country by a hostile foreign power.”
It was not clear from their statement whether McCain knew Fusion GPS was behind the dossier.
While the Fusion GPS oped sheds some light on the manner in which McCain obtained the dossier, the Fusion founders did not name the “emissary” who delivered the document to McCain.
A January 11, 2017 statement from McCain attempted to explain why he provided the documents to the FBI but did not mention how he came to possess the dossier or whether he knew who funded it.
“Upon examination of the contents, and unable to make a judgment about their accuracy, I delivered the information to the director of the FBI,” McCain said at the time. “That has been the extent of my contact with the FBI or any other government agency regarding this issue.”
Sir Andrew Wood, a former British ambassador to Moscow, said McCain first consulted him about the claims inside the dossier at a security conference in Canada shortly after last November’s presidential election.
Wood stated that McCain had obtained the documents from the senator’s own sources. “I told him I was aware of what was in the report but I had not read it myself, that it might be true, it might be untrue. I had no means of judging really,” Wood further told BBC Radio 4 in January.
Last December, Wood related that he served as a “go-between” to inform McCain about the dossier contents. “My mission was essentially to be a go-between and a messenger, to tell the senator and assistants that such a dossier existed,” Wood told Fox News.
In March, Vanity Fair raised questions about the alleged involvement of longtime McCain associate David J. Kramer, a former State Department official, in helping to obtain the dossier directly from Steele. The issue was also raised in a lawsuit filed against Steele by one of the individuals named in the dossier.
Kramer was reportedly questioned by the House Intelligence Committee about his involvement in the dossier affair.
Newsweek reported on an alleged McCain-directed meeting between Kramer and Steele involving the dossier:
Kramer was reportedly directed to meet with Steele in London by McCain, who then received copies of the Trump-Russia dossier and delivered them to the Arizona senator upon returning home. McCain then gave the dossier to the FBI in December 2016.
Briefing to Trump leaked to media, contents of dossier publically disclosed
One issue that could be relevant in Fusion GPS’s admitted decision to turn to McCain is a revelation in the House memo that dossier author Steele was terminated as an FBI source “for what the FBI defines as the most serious of violations – an unauthorized disclosure to the media of his relationship with the FBI in an October 30, 2016 Mother Jones article by David Corn.”
Another issue here is the timing. McCain reportedly delivered the dossier to FBI leadership in December 2016. The memo relates that in early January 2017, prior to Trump’s inauguration, Comey briefed then President-Elect Trump and President Obama on the dossier.
As Breitbart News documented, Comey’s dossier briefing to Trump was subsequently leaked to the news media, setting in motion a flurry of news media attention on the dossier, including the release of the document to the public. The briefing also may have provided the veneer of respectability to a document circulated within the news media but widely considered too unverified to publicize.
On January 10, 2017, CNN was first to report the leaked information that the controversial contents of the dossier were presented during classified briefings on classified documents presented one week earlier to Obama and Trump.
The news network cited “multiple U.S. officials with direct knowledge of the briefings” – in other words, officials leaking information about classified briefings – revealing the dossier contents were included in a two-page synopsis that served as an addendum to a larger report on Russia’s alleged attempts to interfere in the 2016 presidential election.
Prior to CNN’s report leaking the Comey briefing to Trump, which was picked up by news agencies worldwide, the contents of the dossier had been circulating among news media outlets, but the sensational claims were largely considered too risky to publish.
All that changed when the dossier contents were presented to Obama and Trump during the classified briefings. In other words, Comey’s briefings themselves and the subsequent leak to CNN about those briefings by “multiple US officials with direct knowledge,” seem to have given the news media the opening to report on the dossier’s existence as well as allude to some of the document’s unproven claims.
Just after CNN’s January 10 report on Comey’s classified briefings about the dossier, BuzzFeed famously published the dossier’s full unverified contents. When it published the dossier text, BuzzFeed reported that the contents had circulated “for months” and were known to journalists.
The New York Times used CNN’s story on Comey’s briefing to report some contents of the dossier the same day as CNN’s January 10 report on the briefings.
After citing the CNN story, the Times reported:
The memos describe sex videos involving prostitutes with Mr. Trump in a 2013 visit to a Moscow hotel. The videos were supposedly prepared as “kompromat,” or compromising material, with the possible goal of blackmailing Mr. Trump in the future.
The memos also suggest that Russian officials proposed various lucrative deals, essentially as disguised bribes in order to win influence over Mr. Trump.
The memos describe several purported meetings during the 2016 presidential campaign between Trump representatives and Russian officials to discuss matters of mutual interest, including the Russian hacking of the Democratic National Committee and Mrs. Clinton’s campaign chairman, John D. Podesta.
It seems the news media utilized the leak about Comey’s dossier briefings to finally publicize the dossier’s existence and some of its contents even though many news media outlets reportedly possessed some of the dossier information for months.
Yet in his testimony, the FBI’s Comey claimed the opposite was the case. He stated that he and other U.S. officials briefed Obama and Trump about the dossier contents because they wanted to alert the president and president-elect that the news media were about to release the material. It is not the usual job of the U.S. intelligence community to brief top officials about pending news media coverage.
In his prepared remarks before the U.S. Senate Select Committee on Intelligence on June 8, 2017, Comey detailed why he claimed the Intelligence Community briefed Obama and Trump on the “salacious material” – a clear reference to the dossier.
Comey wrote:
The IC leadership thought it important, for a variety of reasons, to alert the incoming President to the existence of this material, even though it was salacious and unverified. Among those reasons were: (1) we knew the media was about to publicly report the material and we believed the IC should not keep knowledge of the material and its imminent release from the President-Elect; and (2) to the extent there was some effort to compromise an incoming President, we could blunt any such effort with a defensive briefing.
